I have just been in contact with the Arc legal assistance team, which is provided with my boat insurance. At the moment I have been refused help on the grounds that on purchase of a new boat with the contract of purchase stating price, including commissioning, and antifouling is part of the commissioning, that as they do not think antifouling is 'goods' as defined in their terms so they can't help. The terms basically provide legal assistance in the event of breach of contract in the purchase or repair of a vessel. The antifoul was a 3 hour 2 coat rush job, but I paid for 2 coats epoxy primer and 2 coats ablative antifoul to be done as manufacturer specs. i am presently appealing their decision, but looks like the fee charged by Pantaenius for legal cover is a waste of cash. Funny thing is it was the Arc legal helpline ( where you speak to a marine lawyer) who said no problems this is exactly what the coverage is for! Caveat Emptor.

Clearly we don't have all detail, but are they saying their insurance does not include an action under The Sale of Goods and Services Act 1982? Not sure where you are with your insurer but certainly worth point out this Act to them. Ian

Caveat Emptor. rgrds alistair Hi a number of years ago we where in a similar position where by the legal insurance initially refused to take a claim relating to a boat purchase we then built a case up and made an appeal against the decision in the end they honored the claim - it ended up costing the insurance co over £25k so its worth arguing the case as an aside we found out later we where the only people to have ever successfully made such a claim and they altered the cover following our claim PM me if you want more info

Good news , after my asking for a rethink and intervention from Pantaenius ARC legal have had a decided to provide the legal assistance, so hopefully we will get a result. rgrds Alistair
